Welcome to CatModoro: Pomodoro & Focus! These Terms of Service and End User License
Agreement (“Terms”) govern your download, access, and use of the CatModoro: Pomodoro & Focus
mobile application (“App”) provided by Barış Kaya (“we,” “our,” or
“us”).
By downloading, installing or using CatModoro: Pomodoro & Focus, you agree to be bound by these Terms. If
you do not agree to these Terms, please do not use the App.
1. Scope of License
We grant you a non-transferable, non-exclusive, revocable license to use CatModoro: Pomodoro & Focus on Apple
iOS and Android devices that you own or control, in accordance with the usage rules set forth by Apple Media
Services Terms and Conditions and the Google Play Terms of Service.
2. User Accounts & Data
- You may access the App using Apple Sign-In or Google Sign-In.
- You are responsible for safeguarding your credentials and for all activities that occur under your
account.
- You may delete your account and associated data at any time directly via the App settings (Profile >
Delete Account) or by contacting us at catmodoro@proton.me.
- We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent
activities.
3. Subscriptions & In-App Purchases (CatModoro Pro)
CatModoro offers optional auto-renewable premium subscriptions (“CatModoro Pro”) as well as
in-app virtual items:
a. Subscription Plans
- Monthly Subscription: Billed on a recurring monthly basis.
- Yearly Subscription: Billed on a recurring annual basis.
- Subscriptions unlock premium features including an ad-free experience, exclusive cat breeds, custom
music/alarm uploads, and enhanced PomoCoin rewards.
b. Payment & Renewal
- Payment will be charged to your Apple ID Account (for iOS users) or Google Play
Account (for Android users) at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the
end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current
period at the rate of the selected plan.
c. Cancellation & Management
You can manage or cancel your subscription at any time:
- iOS Users: Open your device Settings > tap your Apple
ID > Subscriptions > select CatModoro > tap
Cancel Subscription.
- Android Users: Open the Google Play Store > tap your profile icon
> Payments & Subscriptions > Subscriptions > select
CatModoro > tap Cancel Subscription.
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a
subscription.
d. Refunds
All purchases are processed directly by Apple or Google. Refund requests must be submitted directly to Apple
(via reportaproblem.apple.com) or Google Play in accordance with their
respective refund policies.
4. Virtual Currency & Virtual Items (PomoCoins)
- The App includes a virtual currency system (“PomoCoins”) earned through completed Pomodoro
focus sessions.
- PomoCoins, virtual rooms, furniture, and cat variants are purely virtual items for entertainment and
productivity purposes.
- Virtual items have no real-world monetary value, cannot be redeemed for real currency or monetary value,
and cannot be transferred outside the App.
5. Study Rooms & Fair Use
CatModoro provides collaborative focus rooms where users can study together and view shared timers. When
using study rooms, you agree NOT to:
- Use offensive, defamatory or inappropriate room names or usernames.
- Exploit bugs, manipulate background timers, use automated scripts/bots or artificially farm PomoCoins.
We reserve the right to remove inappropriate room/usernames and restrict access for users who violate fair
use.
6. Intellectual Property
All rights, title, and interest in and to CatModoro—including all artwork, isometric designs, music,
character designs, logos, and code—are and remain the exclusive property of Barış Kaya and its
licensors. You may not copy, modify, distribute or reverse engineer any part of the App.
7. Disclaimer of Warranties
CatModoro is provided on an “AS IS” and “AS
AVAILABLE” basis without warranties of any kind, whether express or implied. We do not
guarantee that the App will be uninterrupted, error-free or that timer notifications will never fail due to
device battery-saver or background process limitations. CatModoro is a productivity tool and is not intended
to provide medical or clinical treatment for attention disorders.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the developer be liable for any
indirect, incidental, special, consequential or punitive damages resulting from your access to or use of
the App.
9. Third-Party Beneficiaries & App Store Terms
a. Apple Inc.:
- You acknowledge that these Terms are concluded between you and Barış Kaya only, and not with Apple Inc.
Barış Kaya is solely responsible for the App and its content.
- Maintenance and Support: Barış Kaya is solely responsible for providing any maintenance
and support services. Apple has no obligation whatsoever to furnish any maintenance and support services
with respect to the App.
- Product Claims: Barış Kaya, not Apple, is responsible for addressing any claims
relating to the App, including product liability claims, consumer protection or regulatory compliance.
- Intellectual Property Rights: In the event of any third-party claim that the App
infringes intellectual property rights, Barış Kaya will be solely responsible for the investigation,
defense, settlement, and discharge of any such claim.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has
the right to enforce these Terms against you.
b. Google Inc.: You acknowledge that Google Inc. is not responsible for the App or its
content under these Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye,
without regard to its conflict of law provisions.
11. Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government
embargo or designated as a terrorist-supporting country; and (ii) you are not listed on any U.S. Government
list of prohibited or restricted parties.
12. Privacy Policy
Your privacy is important to us. Please review our Privacy Policy at https://catmodoro.com/privacy to understand how we collect, use, and protect
your information.
13. Changes to These Terms
We reserve the right to modify or update these Terms at any time. Any changes will become effective immediately upon posting the updated Terms within the App or on our website. Your continued use of the App following the posting of changes constitutes your acceptance of such changes.
